Care worker qualifies for redundancy pay based on 20-hour week

By Eimear Byrne

Workplace Relations Commission ·

A care worker was entitled to redundancy pay calculated on a 20-hour week at €12.20 an hour, the WRC found. Her minimum-notice complaint was out of time, so the merits were not decided. Adjudication Officer Gerry Rooney dated the decision 9 May 2016. The care worker said she had worked for the home care provider since 2006, usually 20 to 23 hours a week until November 2014, and received no redundancy payment when her employment ended. The provider argued that she had not been rostered since November 2014 and had received notice of its withdrawal from Ireland. The WRC found her redundancy payment should be calculated as 20 weeks’ pay for a 20-hour week at €12.20 an hour.
