The WRC rejected a data classification analyst’s complaints of discrimination, harassment, victimisation and constructive dismissal against a market research company. The decision was dated 7 December 2016. The analyst said her treatment changed after she announced her pregnancy and alleged problems with breastfeeding facilities and her role after maternity leave. The company denied discrimination, saying its policies applied generally and that it had considered facilities for expressing breast milk. The adjudication officer found no evidence linking the treatment to gender, family status or pregnancy, and found the harassment claim had not been established. The victimisation claim failed because the analyst had not raised a qualifying complaint linked to gender or family status while employed. Her constructive dismissal claim failed because she resigned without giving the company an opportunity to investigate her concerns through its grievance process. All claims failed.
