The Workplace Relations Commission upheld a worker’s complaint that an employer failed to consult properly about changes during a business transfer, requiring payment of four weeks’ remuneration. It found her redundancy dismissal was fair. The decision was dated 22 September 2016. The worker, a cinema financial controller for 17 years, said her work was moved to Dublin after the transfer and she was later made redundant, despite assurances that no measures affecting staff were planned. The WRC found her duties had been progressively diverted to Dublin from the outset and that meaningful consultation had not taken place. It accepted there was reasonable cause for the delay in bringing the transfer complaint. On the dismissal complaint, it accepted the economic reasons for centralising the work and found alternatives had been explored; the worker declined redeployment for personal reasons.
