The WRC refused to extend the time limit for an off-licence supervisor’s unfair dismissal claim against an off-licence, so the claim could not proceed. The decision was dated 10 April 2017. The supervisor said her dismissal for serving alcohol to a minor during a mystery shopper exercise was unfair. The employer maintained that dismissal for gross misconduct was proportionate. The officer noted concerns about how the exercise was conducted, but found that a trainee solicitor’s inadvertent failure to file the complaint in time explained the delay without excusing it. The merits were not decided.
