WRC dismisses former chef’s complaint over missed breaks

By Niamh Kearney

Workplace Relations Commission ·

The WRC found a former chef’s complaint that a hotel denied him statutory breaks not well founded and dismissed it in a decision dated 29 August 2016. The chef said understaffing and workload prevented him taking breaks. The hotel said staff could cover one another and missed breaks could be reported so compensatory breaks could be arranged. The adjudication officer found he had not provided enough evidence to support his claim, noting that he first complained after leaving and gave no specific details of reporting missed breaks.
