The WRC found that an employer wrongly refused a worker force majeure leave and recognised her entitlement to one day of leave for 8 February 2016. The decision was dated 20 October 2016. The worker sought leave after her partner became ill. She said her employer required attendance at a hospital emergency department, although the Act and her contract contained no such requirement. The employer said she had not provided enough information to show the statutory criteria were met. The adjudication officer found the complaint well founded because the employer had not asked for specific details or supporting evidence before refusing the request.
