WRC dismisses special needs assistant’s complaints against government body

By Fionn Kelly

Workplace Relations Commission ·

The Workplace Relations Commission dismissed three complaints by a special needs assistant against a government body because it was not her employer or the correct respondent. The decision was dated 8 March 2017; the merits were not decided. The complaints concerned her employment statement, working-time entitlements and a dispute-resolution process. The adjudicator found that the school and its board of management exercised day-to-day control and were the proper respondent. The assistant’s separate case against the board was heard at the same hearing.
