WRC awards machine operator €1,868.96 for unfair dismissal

Workplace Relations Commission ·

The WRC found that a machine operator was unfairly dismissed and awarded him €1,868.96. Adjudication Officer Marguerite Buckley dated the decision 5 April 2017. The manufacturing company said it treated the employment contract as frustrated because the employee stayed away after being certified fit to return. The adjudicator rejected that argument, finding that the company dismissed him and should have obtained an up-to-date medical report before starting the process to end his employment. Compensation was set at four weeks’ pay; the adjudicator found no financial loss attributable to the dismissal.
