WRC dismisses clerk’s unfair dismissal claim over cash handling

By Niamh Kearney

Workplace Relations Commission ·

The Workplace Relations Commission dismissed a clerk’s unfair dismissal complaint following an investigation into suspected customer short-changing and cash handling. The decision was dated 25 April 2018.

The clerk denied deliberately short-changing customers and said the evidence was circumstantial. She acknowledged that putting her own money into a cash drawer and removing it the next day was procedurally incorrect, but said this was common practice in her office. The service provider said it dismissed her after an investigation and a loss of trust.

The adjudicator accepted that the clerk had not been told the nature of the initial investigation meeting and that covert cameras had been used without her permission, finding procedural flaws. But the officer considered the investigation thorough, the evidence credible and compelling, and the employer’s conclusion reasonable. The procedural flaws were not sufficient to make the dismissal unfair.
