WRC dismisses worker’s constructive dismissal complaint

By Donal Gilhooly

Workplace Relations Commission ·

The Workplace Relations Commission dismissed a worker’s constructive dismissal complaint, finding the employer’s conduct did not justify her resignation. The decision was dated 16 June 2017. The worker said her temporary team leader role was ended without justification and that the employer’s response to her relationship with a colleague contributed to her resignation. The employer said the role was temporary and rotational, that it had addressed her concerns, and that her resignation was unwarranted. The WRC found the role had been advertised as temporary and that the employer was entitled to rotate her out of it. It also found the employer’s actions were not unreasonable enough to justify constructive dismissal.
