The Workplace Relations Commission did not uphold a public transport worker’s complaint about access to a pension scheme, finding it could not recommend changing the rules that made him ineligible. Adjudication officer Emer O’Shea dated the decision 24 May 2018. The worker said two colleagues in similar circumstances had joined the scheme and sought compensation based on an estimated pension value of €93,124.75. The provider said the colleagues had been appointed before age 50 and qualified under the scheme rules, while the worker had been appointed after turning 50. The officer noted that the worker accepted the colleagues had been appointed before 50. She said the claim could only be conceded by amending a statutory instrument, which she had no jurisdiction to recommend.
