The WRC dismissed a food delivery driver’s four claims against a fast food restaurant after finding he was not an employee. In a decision dated 15 June 2017, the adjudication officer said the arrangement was a loose relationship in which the driver kept a €2 fee for each delivery. The driver had claimed he was constructively dismissed and was owed written employment terms, written notice of a change to those terms and minimum notice. The respondent said he had been a self-employed driver engaged by the previous owner and was not recorded as an employee after the business transferred. The officer found there was no employment relationship for the purposes of the cited Acts. All four claims were dismissed because the driver did not qualify as an employee.
