The Workplace Relations Commission rejected an operative’s complaint about a change to her seniority ranking. The decision was dated 13 October 2016. The operative said the revised list had moved her down 11 places, affecting the allocation of duties and annual leave. The service provider said it was applying a collective agreement and a binding Labour Court Monitoring Group determination, under which 11 part-time workers received credit for earlier service. The adjudication officer found that the service provider was implementing the binding determination and did not accept that the operative had been treated less favourably or unfairly.
