The Workplace Relations Commission awarded an assistant production controller €25,000 after finding her dismissal unfair. The decision was dated 26 October 2016.
The worker had 26 years of service with a manufacturing company. She said she was made redundant without consultation and was not considered for an operations planning coordinator role announced on the day she was dismissed. The company said falling sales had led it to restructure, her administrative duties could be shared among other staff, and no suitable vacancy existed.
The adjudication officer found no credible evidence that the company had fairly assessed her selection for redundancy or considered whether she could be redeployed. The officer also noted that she had no advance warning or chance to respond, seek advice or representation, and that the other role was announced on the day of her dismissal. The officer found the selection process unfair and ruled that the dismissal was unfair.
The €25,000 compensation reflected her financial loss and was awarded in addition to payments she had already received, including statutory redundancy pay.
