The WRC found that a café unfairly dismissed a catering assistant because of her trade union membership and awarded her €1,750 in compensation. The decision was dated 18 November 2016.
The worker said her union had raised workplace concerns and sought a meeting with the manager before she was dismissed. The café said it terminated her employment because of a downturn in business. The adjudication officer found there was no evidence of poor performance and was not convinced the dismissal was based on the downturn. He concluded that the café dismissed her under the guise of rationalising its business after a call from the union.
