WRC finds warehouse operative’s dismissal fair

By Donal Gilhooly

Workplace Relations Commission ·

The Workplace Relations Commission dismissed a warehouse operative’s unfair-dismissal complaint after finding the dismissal fair. Adjudication officer Pat Brady dated the decision 6 July 2017. The worker accepted fault for a vehicle incident but argued dismissal was disproportionate, citing his 19 years’ service and other possible sanctions. The logistics company said the incident breached safety rules, followed an earlier warning and involved operating equipment without a licence. The WRC found the procedure fair and concluded the company had justified dismissal within the range of reasonable responses, considering the safety implications. The complaint was dismissed.
