The WRC awarded a home care worker €3,500 after finding her dismissal unfair because of serious flaws in the disciplinary process. The decision was dated 29 August 2017. The home care provider alleged that the worker took a client’s money without permission and failed to account for shopping. The worker said the client had given her the money and she had not yet had the chance to shop. The WRC found she held €40 or €41 for shopping and that there was no evidence of personal financial gain, but said keeping the money while the client needed food was a breach. The provider did not give the worker the underlying statements, combined investigation and disciplinary stages, and offered no appeal. The WRC declined reinstatement and awarded compensation, taking account of the provider’s procedural failings and the worker’s contribution to her dismissal.
