A cashier won €100 over Sunday premium pay but lost her rest-break complaint, the WRC found in a decision dated 28 October 2016. The adjudication officer found that the entertainment centre’s contract did not clearly identify payment for Sunday work. The cashier said she worked Sundays without a premium and received no break during her shift. The entertainment centre argued that her €10 hourly rate included Sunday premium and that she had breaks. The officer found the rate did not meet the statutory requirement. The rest-break complaint was not well founded: the officer preferred the employer’s records and noted that the cashier had not raised the issue during her employment.
