WRC recommends €900 for Cashier after employer failed to keep rest-break records

Workplace Relations Commission ·

A WRC adjudicator recommended that a financial-sector employer pay a Cashier €900 for failing to keep records of her rest breaks. A separate complaint that she was unfairly dismissed was recommended as not well founded. The recommendation was dated 3 October 2017. The Cashier said she worked eight or nine hours a day without breaks and was dismissed after challenging how her manager spoke to her. The employer said she left voluntarily and took breaks away from her desk. The adjudicator found that the Cashier had not followed the company grievance procedure in raising her dismissal complaint. On rest breaks, the employer provided working-hours records but no records of the breaks taken. The adjudicator recommended €900 for the failure to provide rest breaks.
