WRC dismisses maintenance supervisor’s constructive dismissal complaint against charity

By Orla Quinn

Workplace Relations Commission ·

The Workplace Relations Commission dismissed a maintenance supervisor’s constructive dismissal complaint against a charity, finding that he resigned voluntarily. Adjudication Officer Aideen Collard dated the decision 24 October 2017. He said the charity had not offered light duties and had pressed him to consider its permanent health insurance scheme. The charity said no suitable light-duty role was available and that he chose to resign to access his pension lump sum. The charity described a €30,000 severance offer that he rejected and a €5,000 gratuity paid when he left. The officer found he had not pursued a return to work and had no evidence that he requested light duties. She concluded the charity’s conduct was not so unreasonable as to force his resignation. The complaint was found unfounded and dismissed.
