WRC finds factory operative’s dismissal fair

By Orla Quinn

Workplace Relations Commission ·

The WRC found a factory operative’s dismissal by a food manufacturing company fair and her unfair dismissal complaint not well founded. The decision, dated 9 March 2018, said the company had run an investigation and disciplinary process, given her an opportunity to respond and allowed an appeal. The company said it dismissed her after finding she had tried to direct a colleague and used abusive language while already on a final written warning. She disputed the allegations and challenged the investigation and disciplinary process. The officer found it reasonable for the company to consider the warning, which remained in force after she withdrew her Labour Court appeal concerning it.
