WRC awards shop assistant €750 over unnotified hours cut

Workplace Relations Commission ·

The WRC awarded a shop assistant €750 after finding that her hours were reduced without notice when she returned to work. The decision was dated 18 November 2016.

The shoe-store assistant said her hours and duties were cut after she returned from sick leave. The employer said the reduced hours were temporary because the rota had already been allocated, and that it would review changes to her duties.

The WRC found that the reduction in hours should have been discussed and agreed. It did not recommend in favour of her constructive-dismissal claim because she had not shown that she raised the matters with the employer before going on sick leave or afterward, apart from sick certificates.
