A team leader received €5,000 for unfair dismissal and €942 for a minimum-notice breach after the Workplace Relations Commission found flaws in the investigation that led to his dismissal. Adjudication officer John Walsh dated the decision 17 July 2017.
The worker denied taking cash from a self-scan till. The retail store said CCTV and cash checks supported its conclusion that about €735 was missing, and cited his admitted breach of staff purchase rules by buying scratch cards himself.
The WRC found the investigation manager had gone beyond her role by concluding that the worker took the money. She had not established that system error had been ruled out when she issued her report; the relevant information arrived later. The officer found the report may have influenced the disciplinary manager’s decision. Both complaints succeeded, and the compensation was payable within six weeks.
