WRC finds worker entitled to redundancy after employer misses hearing

By Fionn Kelly

Workplace Relations Commission ·

The Workplace Relations Commission found a worker entitled to redundancy after his employer failed to attend a hearing. The decision was dated 15 February 2017. The worker said he was put on temporary lay-off in January 2016 after work ended for the Christmas holidays. He submitted a redundancy form after no work became available and said the employer later refused to pay redundancy or notice. The employer had maintained that work was offered and that the worker had not been dismissed. With the employer absent without explanation, adjudication officer John Tierney accepted the worker’s uncontested evidence and found the claim well founded. The worker was entitled to redundancy from the employer.
