Pharmacist wins €118.56 sick-pay complaint; holiday-pay claim fails

Workplace Relations Commission ·

A sessional pharmacist won €118.56 in a sick-pay complaint, while his holiday-pay complaint failed, in a Workplace Relations Commission decision dated 8 February 2017. The pharmacist said four hours were deducted from his sick pay after he missed weekend shifts because of illness. His employer had agreed to repay one hour before the hearing; the WRC ordered payment of the remaining three hours, finding no document that contradicted his entitlement to the four hours. On holiday pay, the WRC accepted that Sunday premium hours should count towards the calculation. It found, however, that the pharmacist had not explained the basis for the additional five hours he claimed for July 2015 to January 2016, so that complaint was not well founded.
