A general operative won three complaints against a construction subcontractor, receiving €495 for notice pay and €1,980 each for unpaid annual leave and missing written employment terms. The WRC decision was dated 19 October 2017. The worker said the subcontractor stopped assigning him work and denied that he had resigned. The respondent said he had resigned, refused alternative work and had been paid for leave. The WRC found there was insufficient evidence that he had resigned, that annual leave remained unpaid and that no written statement of his employment terms had been provided. The unfair dismissal complaint was outside the WRC’s jurisdiction because the worker had not established one year’s continuous service; the merits were not decided. He withdrew his public holiday claim at the hearing.
