WRC awards sales supervisor €23,500 for unfair dismissal

Workplace Relations Commission ·

The Workplace Relations Commission awarded a sales supervisor €23,500 after finding she was unfairly dismissed by a wholesale and retail distribution company. In a decision dated 28 November 2016, the adjudication officer found the company failed to give her fair notice that her continued employment was at risk or a proper opportunity to respond before deciding to dismiss her while she was on sick leave.

The company said her lengthy absence put pressure on staff and that its decision was informed by medical assessments. The officer found the dismissal process premature, but rejected her contention that she was eligible or likely to be made redundant.

The compensation included four months’ salary and €7,500 for estimated ongoing losses over six months.
