WRC finds dismissal after failed drug test was fair

By Gráinne Nolan

Workplace Relations Commission ·

The Workplace Relations Commission found that a meat processing plant had substantial grounds to dismiss a worker after he failed a drug test, and dismissed his unfair dismissal complaint. The decision was dated 7 December 2016. The worker argued that his dismissal followed complaints about workplace injuries and said others with similar test results received warnings. The employer said its zero-tolerance policy applied after random testing, an investigation and an opportunity to appeal. The adjudicator found the worker knew the policy, had failed the test at three times the stated limit and posed a safety risk in a plant using knives and other dangerous equipment.
