The Workplace Relations Commission ordered a logistics company to pay a customer service agent €400 after finding he did not receive the benefit of eight days’ annual leave that coincided with certified illness. The decision was dated 9 February 2017. The company said the annual leave had been paid in error and should have been unpaid sick leave. It offered either repayment with the leave restored or future unpaid leave. The adjudicator found the overpayment should have been dealt with separately from whether the worker received his leave entitlement. The related industrial-relations claim had already been addressed under the working-time claim and could not reasonably succeed.
