Cabin crew member’s disability discrimination complaint over promotion fails

By Cathal Brosnan

Workplace Relations Commission ·

The WRC found that a cabin crew member’s disability discrimination complaint over exclusion from a promotion process failed. In a decision dated 14 June 2017, Adjudication Officer Eugene Hanly found she had not established a comparator or a case of discrimination. The aviation company said applicants with live disciplinary sanctions were screened out under its attendance criteria. The officer found the vacancy required an excellent attendance record and that the employee did not meet that requirement. Five other applicants were also excluded because they had sanctions on file. On a separate industrial relations dispute, the officer recommended no intervention because the employee had not raised a formal grievance locally. The disability discrimination complaint failed on its merits.
