WRC finds dismissal of back-office advisor was fair

By Niamh Kearney

Workplace Relations Commission ·

The Workplace Relations Commission found the dismissal of a back-office advisor was fair in a decision dated 12 January 2018. The employer had sought to have the case dismissed because the employee did not appeal internally, but the adjudication officer rejected that application and heard the unfair-dismissal case. The employer said it dismissed the employee after performance, attendance and punctuality problems persisted despite improvement plans, coaching and warnings. The employee argued that changing shifts and a lack of flexibility over shorter hours contributed to her difficulties, and that dismissal was too severe. The officer found the employer had made substantial efforts to support her and genuinely believed her performance problems could not be resolved. Despite reservations about parts of the process, the officer found the dismissal was within the range of reasonable responses.
