WRC rejects driver’s disability discrimination complaint against security company

Workplace Relations Commission ·

The WRC rejected a driver’s disability discrimination complaint against a security company, finding the worker had not raised reasonable accommodation at a key meeting about returning to work. Adjudication Officer John Tierney dated the decision 21 February 2018. The driver said the company failed to accommodate him and that its conduct led him to resign. The security company said it discussed possible changes and alternative roles with him, and that he was not pressured to return before he was ready. The WRC noted that the driver had access to professional and union advice but did not raise reasonable accommodation at the January 2016 meeting. It found the complaint not well founded.
