The WRC awarded a customer relations adviser €5,000 after finding his dismissal unfair because his employer failed to follow its appeal procedure and hear him. The decision was dated 23 May 2017. The computer company said persistent performance problems justified dismissing him after improvement plans, warnings and support. The adjudicator accepted that the grounds for dismissal were justified but found the appeal process procedurally unfair. The award took account of the adviser's substantial contribution to his dismissal. A separate Industrial Relations Act complaint could not succeed because the issue had already been addressed in the unfair dismissal claim.
