Healthcare assistant’s €3,386 wages claim fails

By Niamh Kearney

Workplace Relations Commission ·

The Workplace Relations Commission rejected a healthcare assistant’s two complaints over €3,386 in claimed lost wages. The decision was dated 13 December 2016. The worker said she was suspended after seeking the same breaks as directly employed staff. Her employment agency said the client sent her home after she did not return from a break when asked, and that the agency assigned her other work and paid her for all hours worked. The adjudication officer found that the client had removed her from its site rather than suspended her. Her contract did not guarantee hours and provided payment only for hours worked, so she had no contractual entitlement to wages for hours she had not worked. Both complaints failed.
