The Workplace Relations Commission found that medical outsourcing company did not discriminate against a support nurse when it ended her employment after she could not accept a proposed shift pattern. Adjudication Officer Eugene Hanly dated the decision 5 May 2017.
The support nurse said evening and weekend work conflicted with her family responsibilities and that the company had not properly considered alternatives. The company said its client required an integrated Irish and UK support rota, including evening and weekend shifts.
The WRC found that the evidence did not establish the required disadvantage and that any possible indirect discrimination was objectively justified by operational needs. The separate unfair dismissal complaint was withdrawn.
