WRC rejects worker’s unfair-dismissal claim after refusal to join further investigation

By Niamh Kearney

Workplace Relations Commission ·

The WRC found a worker’s unfair-dismissal claim not well founded after concluding that her refusal to take part in a further disciplinary investigation contributed greatly to her dismissal. The decision was dated 21 April 2017. The worker said a director had overturned her original dismissal on appeal, but a manager then barred her return and arranged another investigation into the same matters. The employer said the dismissal was upheld on appeal and alleged theft. The adjudication officer found that the worker declined to take part in the second investigation and did not deny the allegations. The claim failed on its merits.
