WRC rejects religious discrimination complaint over cake order

By Gráinne Nolan

Workplace Relations Commission ·

The Workplace Relations Commission rejected a man’s religious discrimination complaint against a shop/bakery over its refusal to make a cake bearing his requested message. The decision was dated 10 July 2017.

The complainant said the bakery would make a cake for a gay couple but refused his request, which he said was intended to express his religious beliefs. The bakery said its bespoke order book was full and the design was unusually detailed; it offered to make the cake base and suggested getting an edible topper elsewhere.

The adjudication officer found no evidence that the order was refused because of the man’s religious beliefs. The complaint failed because he did not establish a prima facie case of discrimination.
