WRC dismisses job applicant’s discrimination complaint against statutory body

By Aoife Loughran

Workplace Relations Commission ·

The WRC dismissed a job applicant’s discrimination complaint against a statutory body because it was not the correct respondent. Adjudication officer Shay Henry dated the decision 5 April 2017. The applicant said the recruitment body, called Body A in the decision, refused to let him retake a psychometric test after he had been ill. The statutory body confirmed that refusal on appeal. It said its role was to oversee recruitment standards and examine complaints about compliance with its code of practice. The WRC found it had investigated the complaint and had no further role in recruitment. The applicant would have needed to bring his Employment Equality Act claim against Body A.
