The WRC upheld a medical practice nurse’s claim to statutory redundancy after her general practitioner employer retired. The decision was dated 16 June 2017. The nurse had worked for the GP since 2000. She said he retired in April 2016 and sought redundancy pay. The GP argued she had been hired immediately by the new GP on the same terms, so there was no redundancy liability. The adjudicator found that the GP’s GMS contract was specific to him and could not be transferred to another person. The WRC ruled that the nurse was entitled to a statutory redundancy payment based on her insurable employment with the GP and required him to pay it in accordance with the Act.
