WRC dismisses Salesman’s four complaints after finding he was not an employee

Workplace Relations Commission ·

The Workplace Relations Commission dismissed a Salesman’s four complaints against a Franchise Operator after finding he was not an employee. Adjudication officer Joe Donnelly dated the decision 15 May 2017. The Salesman said he attended trade shows, sought customers for an ice-cream import business and was owed wages, holiday pay and notice. The operator said he was initially to receive expenses and would become an employee if the agency succeeded. The officer found the payments were irregular and mostly expense reimbursements, and that the unsigned letter offering a €26,000 salary had been written by the Salesman for personal purposes. All four complaints failed because he was not an employee.
