WRC rejects office manager’s constructive dismissal complaint

By Ruairí Dolan

Workplace Relations Commission ·

The WRC rejected an office manager’s constructive dismissal complaint against an office, finding she had not satisfied the legal test for the claim. The decision was dated 9 June 2017. The manager said she resigned after being asked to reduce her hours amid financial difficulties. The respondent did not attend the hearing. The evidence was that all employees had been asked to reduce their hours and that redundancy was discussed while she worked her notice. The manager began another job on 5 September 2016, at an annual salary of €36,000 compared with €33,000 in her previous role. The adjudicator found she had suffered no financial loss.
