WRC awards factory worker €1,537 for constructive dismissal

By Aoife Loughran

Workplace Relations Commission ·

The Workplace Relations Commission found that a factory worker was constructively dismissed and awarded her €1,537. Adjudication officer Niamh O’Carroll Kelly dated the decision 25 May 2017. The worker said mandatory overtime, irregular hours and extra duties became difficult to manage. She told the factory about her difficulties and provided medical evidence, but the adjudicator found the employer ignored her requests and increased the pressure on her. The factory did not attend the hearing. Although her contract required flexibility, the adjudicator found it was reasonable for her to resign. Compensation was limited to four weeks’ pay because she received illness benefit and chose to take a course rather than seek work.
