The WRC dismissed a health care worker’s unfair-dismissal claim, finding that the decision to dismiss him fell within the range of reasonable responses for an employer in the health and social care sector. The decision was dated 10 July 2017.
The worker was dismissed after an internal disciplinary process concerning an allegation of sexual harassment by a fellow employee. He argued that the process was outside the employer’s policy, delayed, biased and procedurally unfair. The health care organisation said it had investigated thoroughly and followed fair procedures.
The adjudication officer found that natural justice and fair procedures had been observed, and that dismissal was a reasonable decision in the circumstances. An internal appeal had also upheld the dismissal. The WRC decision concerned the unfair-dismissal claim.
