WRC rejects a sales consultant’s claim that pregnancy led to dismissal

By Cathal Brosnan

Workplace Relations Commission ·

The Workplace Relations Commission rejected a sales consultant’s unfair dismissal claim, finding that her fixed-term contract ended rather than her employment being terminated because of her pregnancy. The decision was dated 9 June 2017.

The consultant said she told her manager about her pregnancy and was informed she was being let go. She argued that her pregnancy was the reason. The trader said her written contract was for a fixed period and was not intended to be extended.

The adjudicator found that the fixed-term contract was the basis of the consultant’s employment and that its expiry was not wholly or mainly due to her pregnancy. The decision noted that she had performed well and at times covered for her manager, but found that this did not alter the contract terms. The claim failed on its merits.
