Worker’s penalisation and equality complaints fail after bullying dispute

By Tadhg O'Sullivan

Workplace Relations Commission ·

A healthcare worker’s penalisation and equality complaints against a healthcare provider failed after the WRC found no retaliation or disability discrimination. The worker withdrew her gender discrimination complaint at the hearing. The audiologist, who had worked for the provider for 27 years, said she was moved from audiology into administrative and receptionist roles after making a bullying complaint against her line manager. The provider said the moves reflected operational constraints and offered her a return to audiology away from the manager, which she declined. The WRC found that the temporary transfers were warranted and not penalisation, and that the worker had not established disability discrimination, a failure to provide reasonable accommodation, victimisation or harassment. Adjudication officer James Kelly dated the decision 1 February 2018.
