WRC finds nurse’s constructive dismissal complaint not well founded

Workplace Relations Commission ·

The WRC found a nurse’s constructive dismissal complaint not well founded after she resigned from a hospital without lodging a formal grievance or attending scheduled mediation. Adjudication Officer Rosaleen Glackin dated the decision 12 June 2017. The nurse said the hospital had ignored risk concerns she raised and that management had encouraged a complaint against her. The hospital said she resigned before mediation and before an investigation could take place, despite being invited to use the grievance procedure. The officer found no breach of contract and concluded the nurse had not acted reasonably by resigning before lodging a grievance or attending mediation. The decision also refers to an earlier, separate award that was reduced on appeal; that compensation was not awarded in this case.
