WRC awards childcare worker €9,500 after finding dismissal unfair

Workplace Relations Commission ·

The Workplace Relations Commission awarded a childcare worker €9,500 after finding her dismissal unfair. The decision was dated 12 June 2017. The officer found that the crèche manager who raised the complaint also took part in fact-finding and disciplinary proceedings. The committee chair helped investigate, recommended dismissal and then took part in the committee's decision to accept that recommendation. The officer found both processes breached fair procedures. The worker could reasonably rely on a supervisor who was present during the first incident, so it was unfair to count that incident against her. But she was wrong not to report a second incident, and that contributed to her dismissal. The officer took her contribution into account in setting compensation.
