Workplace Relations Commission ·

The Workplace Relations Commission upheld a maintenance manager’s constructive dismissal and unpaid-wages complaints against a company, awarding him €20,000 for the dismissal and €14,538.73 net for unpaid wages. The decision was dated 12 June 2017.

The manager said he received no wages from June to September 2016 and resigned after repeated appeals to the managing director went unanswered. The company accepted that the wages were owed, but said the loss of a large contract and delayed payments had made it difficult to meet salaries. It also argued that the manager, a senior manager and shareholder, knew about the company’s financial position.

The adjudication officer found the constructive dismissal complaint well founded and awarded €20,000 in compensation. He also found the unpaid-wages complaint well founded and required the company to pay €14,538.73 net in compensation for breach of the Payment of Wages Act.
