WRC rejects cleaner’s constructive dismissal complaint

By Rory Hanlon

Workplace Relations Commission ·

The WRC found a cleaner’s constructive dismissal complaint against a small independent retailer was not well founded. Adjudication Officer Marguerite Buckley dated the decision 11 January 2017. The worker said she believed she would be fired and that the retailer’s conduct forced her to leave. The retailer said she had been absent since November 2015, that it had repeatedly sought to discuss her return, and that it had not dismissed her. The officer found no significant breach of contract and considered the retailer’s attempts to contact her reasonable. She also noted that the worker had not submitted a resignation or told the retailer she considered herself constructively dismissed. The complaint was dismissed.
