The WRC rejected a business development manager’s constructive dismissal complaint, finding that he had not shown he had no option but to resign. Adjudication Officer Eugene Hanly dated the decision 25 April 2017. The worker alleged bullying, threats and that the handling of his grievance made his role untenable. The Online education company said he resigned voluntarily and had not completed its grievance process. The adjudicator found the worker was not bullied and that his targets were not unrealistic. He did find that the CEO acted inappropriately by criticising the worker’s performance while he was on stress leave, but concluded this did not make resignation unavoidable. The worker had not exhausted the grievance procedure or waited for the co-founder to return to address his complaint.
